Does Massachusetts 201 CMR 17.00 apply to construction companies?
Almost certainly. 201 CMR 17.00 applies to any business that owns or licenses personal information about Massachusetts residents, and every contractor with Massachusetts employees holds it: Social Security numbers, driver’s license numbers and bank account numbers for payroll. The regulation requires a written information security program, often called a WISP, and specific safeguards, including encrypting that information on laptops and when it’s sent over public networks or Wi-Fi. Your attorney has the final word on how it applies to you.
What should a Massachusetts construction company’s written information security program include?
201 CMR 17.00 lists the core pieces: a designated person responsible for the program, an assessment of risks to personal information, employee training, rules for storing and carrying records off-premises (which matters when paperwork and laptops travel to job sites), prompt removal of access when someone leaves, oversight of vendors that handle the data, and a review at least once a year. We help clients put the technical controls in place and keep the documentation current.
What happens if a Massachusetts construction company has a data breach?
Massachusetts law requires you to notify affected residents, the Attorney General’s office and the Office of Consumer Affairs and Business Regulation as soon as practicable and without unreasonable delay. That means you need to know quickly what was taken and whose information it was, which is far easier with good logging, backups and a response plan already in place. Call your attorney the moment you suspect a breach.
What does Rhode Island require if our company holds employee or customer data?
Rhode Island’s Identity Theft Protection Act requires any business that holds personal information about Rhode Island residents to maintain a risk-based information security program with reasonable security procedures, along with retention and secure destruction practices. After a breach, affected residents must be notified within 45 calendar days of confirming it, and the Attorney General must be notified if more than 500 Rhode Islanders are affected. Your attorney can confirm what applies to you.
How do we keep job site trailer equipment running through a New England winter?
Plan for cold, condensation and unreliable power. Keep network gear off the floor in a ventilated enclosure, put it on a battery backup so temporary power and generator swaps don’t knock the site offline, and keep spare batteries for tablets and phones, which drain fast in the cold. Remote monitoring matters most in winter: we see when a trailer drops offline and can often fix it before the crew arrives.
